TERMS OF SERVICE

These terms cover bookings made through shotbytony.photos for sports, portrait, couples, family, and custom/event photography services provided by ShotByTony ("we," "us," "our"), based in the East Bay, CA. By booking a session, you agree to these terms.

Booking & Scheduling

Sessions are booked through our Calendly scheduling page or, for custom/team/event requests, by text or call. A booking is confirmed once you receive a confirmation through Calendly (or, for custom requests, once we've agreed on details directly with you).

Pricing & Payment

Current pricing for each package is listed on this site and is accurate as of the date you book. Team, tournament, organization, and custom/event bookings are quoted individually.

Sports sessions require full payment at the time of booking. Portrait, couples, family, and event sessions require 50% of the total price at booking, with the remaining balance due before or at the session.

A travel fee applies when the shoot location falls outside our normal East Bay service area, as noted on the pricing pages.

Rescheduling & Cancellations

You may reschedule your session up to 48 hours before the scheduled time at no charge. Cancellations or reschedule requests inside that 48-hour window may not be guaranteed a new slot, depending on availability.

We reserve the right to reschedule a session due to circumstances outside our control (severe weather, illness, equipment failure, venue closure, etc.), and will work with you to find a new time as soon as possible.

Photo Delivery

Edited photos are delivered digitally, typically within 24 hours to 1 week depending on photographer availability. In rare cases or emergencies, delivery may take longer than the typical window — if this happens, we'll keep you updated. Sports sessions include 20+ edited photos as described on the pricing page; portrait and event packages vary by session length and package.

Image Usage & Rights

Once delivered, you're free to use your photos for personal use — printing, sharing, social media, etc. ShotByTony retains the copyright to all images and reserves the right to use select photos from any session for portfolio display on this website, on Instagram, and in other promotional materials, unless you request otherwise in writing before your session.

Photos may not be sold, used commercially, or altered/re-edited by a third party without our written permission.

Sessions Involving Minors

For any session where the subject is under 18, the booking must be made by a parent or legal guardian, who is confirming they have the authority to consent to both the photography session and the image usage terms above on the minor's behalf.

Liability

We take care to deliver high-quality work, but we can't guarantee specific results (weather conditions, game outcomes, venue restrictions, and similar factors are outside our control). Our liability for any issue with a session is limited to the amount paid for that session. We are not responsible for indirect or consequential damages.

Conduct at Sessions

We expect a respectful, safe environment at every shoot. We reserve the right to end a session early, without refund, if conduct becomes unsafe or abusive toward the photographer or others present.

Governing Law

These terms are governed by the laws of the State of California.

These terms may be updated from time to time. The "Last updated" date at the top of this page reflects the most recent version.
